These Terms & Conditions govern your use of our website, travel enquiries, bookings, tours, holiday packages and related travel services. By accessing our website, submitting an enquiry, making a payment, confirming a booking or participating in a tour arranged by us, you acknowledge that you have read, understood and agreed to these Terms & Conditions. If you do not agree with any part of these Terms, please do not use our website or services. ⸻ 1. About Us Motherland India Holidays Pvt. Ltd. is an India-based travel and inbound tour operator providing travel planning, tour packages, accommodation arrangements, transportation, sightseeing, ground handling and related travel services. Our services may include arrangements provided directly by us and/or through independent third-party suppliers such as hotels, airlines, railways, transport operators, guides, activity providers, destination management partners and other service providers. ⸻ 2. Travel Enquiries & Quotations All enquiries submitted through our website are subject to availability and confirmation. Any itinerary, quotation, price, hotel recommendation, photograph, description or travel suggestion provided before confirmation is indicative unless specifically stated otherwise. A quotation may change before booking confirmation due to: * Hotel availability * Changes in airline, railway or transportation fares * Seasonal pricing * Government taxes or fees * Supplier price changes * Currency fluctuations * Changes in itinerary or inclusions * Changes requested by the traveller A booking becomes confirmed only after the required payment has been received and written confirmation has been issued by Motherland India Holidays Pvt. Ltd. ⸻ 3. Prices & Taxes All prices are quoted in the currency specified in the quotation. Unless specifically stated otherwise, applicable government taxes, GST, entrance fees, permits, surcharges or other mandatory charges may be payable in addition to the quoted base price. The applicable taxes and charges will be communicated in the quotation, invoice or booking confirmation wherever applicable. Any change in government taxes, statutory charges, airport fees, fuel surcharges or other mandatory levies after quotation may be payable by the traveller. ⸻ 4. Booking Confirmation & Payment A booking is subject to the payment schedule mentioned in the applicable quotation or invoice. The required advance payment must be received within the specified period to secure the booking. Failure to make payment within the agreed timeline may result in: * Cancellation of the provisional booking; * Release of hotel rooms or other services; * Change in prices; * Loss of availability; or * Application of applicable cancellation or supplier charges. For certain services, full payment may be required at the time of booking. Payment confirmation does not by itself constitute confirmation of every individual travel component. Final confirmation is subject to availability and written confirmation from the company. ⸻ 5. Payment Methods Payments may be made through the payment methods communicated by Motherland India Holidays Pvt. Ltd. Customers should make payments only through officially communicated company payment channels. The company will not be responsible for payments made to unauthorised persons, personal accounts, fraudulent links or third parties claiming to represent the company. Customers are advised to verify payment details with our authorised representative before making a payment if there is any doubt. ⸻ 6. Cancellation & Refund Policy Cancellation charges depend on the nature of the services booked and the cancellation terms imposed by the respective suppliers. Different suppliers may have different cancellation policies, including hotels, airlines, railways, transport providers, cruise operators, activity providers and other service partners. Therefore, the cancellation terms applicable to a particular booking will be those communicated in the quotation, booking confirmation, invoice or applicable supplier terms. Where a supplier permits a refund, Motherland India Holidays Pvt. Ltd. will process the eligible refund after deduction of applicable: * Supplier cancellation charges; * Airline/railway cancellation charges; * Hotel cancellation charges; * Bank/payment gateway charges, where applicable; * Administrative or service charges, where applicable; * Non-refundable amounts; and * Taxes or other applicable charges. Certain bookings may be completely non-refundable. Where a supplier does not provide a refund, Motherland India Holidays Pvt. Ltd. may not be able to provide a refund for that component. Refunds, where approved, will generally be processed through the original payment method or another mutually agreed method, subject to applicable banking and payment procedures. ⸻ 7. No-Show, Late Arrival & Early Departure No refund will ordinarily be payable for: * Failure to arrive for a confirmed service; * Late arrival; * Missed transportation; * Unused hotel nights; * Voluntary early departure; * Unused sightseeing or activities; or * Services voluntarily not utilised by the traveller, unless the relevant supplier’s policy permits otherwise. Travellers are responsible for arriving at the designated departure point on time. ⸻ 8. Changes Requested by the Traveller Any request to change confirmed travel arrangements is subject to availability and supplier approval. Changes may result in additional charges, including: * Fare differences; * Hotel rate differences; * Cancellation charges; * Rebooking fees; * Transportation charges; * Administrative/service charges; and * Applicable taxes. The company will communicate the additional cost before implementing a material change wherever reasonably practicable. ⸻ 9. Hotels & Accommodation Hotel names and categories mentioned in an itinerary are subject to availability. If the confirmed hotel becomes unavailable due to circumstances beyond our reasonable control, we may arrange an alternative hotel of the same or comparable category, subject to availability. Hotel facilities, room categories, meal plans, check-in/check-out times, extra beds, child policies, deposits and other conditions are governed by the respective hotel’s policies. Special requests such as adjoining rooms, specific room views, early check-in, late check-out, particular room numbers or specific bed configurations are requests only and cannot be guaranteed unless expressly confirmed in writing. Early check-in and late check-out are subject to hotel availability and may involve additional charges. ⸻ 10. Transportation Transportation may be provided by independent third-party transport operators. Vehicle type, model and seating capacity will be based on the confirmed itinerary and availability. Vehicle images shown on the website or in promotional material are illustrative and may not represent the exact vehicle supplied. The company will make reasonable efforts to provide the transportation included in the confirmed itinerary but shall not be responsible for delays, breakdowns, traffic restrictions, road closures, weather conditions, government restrictions or other circumstances beyond its reasonable control. ⸻ 11. Flights, Railways & Other Tickets Airline, railway and other transportation services are governed by the terms and conditions of the respective carrier. Motherland India Holidays Pvt. Ltd. acts as a travel facilitator/arranger for such third-party services where applicable. Flight schedules, fares, baggage allowances, seat allocation, cancellations, delays, rescheduling and refunds are controlled by the relevant carrier. Any airline or railway refund will be subject to the carrier’s applicable rules and fare conditions. Travellers are responsible for checking their travel documents, flight/rail details and reporting times. ⸻ 12. Passport, Visa & Travel Documents Travellers are solely responsible for ensuring that they possess valid: * Passports; * Visas; * Entry permits; * Transit visas; * Travel insurance, where required; * Vaccination or health documents, where applicable; and * Other documents required by the destination or transit authorities. Motherland India Holidays Pvt. Ltd. may assist with general travel information or visa-related coordination where such service is specifically agreed. However, visa approval, immigration clearance and entry into any country are decisions of the relevant government or immigration authorities and cannot be guaranteed by the company. The company shall not be responsible for losses arising from visa refusal, invalid documents, passport issues, immigration refusal or failure to meet entry requirements. ⸻ 13. Travel Insurance Travellers are strongly advised to obtain appropriate travel insurance covering, where relevant: * Medical emergencies; * Trip cancellation; * Trip interruption; * Lost baggage; * Travel delays; * Personal liability; * Emergency evacuation; and * Other travel-related risks. Unless expressly stated in the booking confirmation, travel insurance is not included in the tour price. ⸻ 14. Health, Fitness & Special Requirements Travellers are responsible for assessing their own fitness and ability to participate in planned activities. Travellers should inform us before booking about any material mobility requirements, dietary requirements, accessibility needs or other special arrangements that may affect the travel services. Certain destinations and activities may involve altitude, walking, stairs, uneven terrain, weather conditions, remote locations or other physical requirements. We will make reasonable efforts to communicate known requirements, but travellers remain responsible for determining whether an activity is suitable for them. ⸻ 15. Activities & Adventure Experiences Certain tours may include activities involving inherent risks. Participation in adventure, wildlife, trekking, water sports, mountain travel or other specialised activities may be subject to the terms, safety rules and waiver requirements of the respective activity provider. Travellers must follow reasonable safety instructions provided by the supplier or local authorities. The company does not guarantee that every activity will operate in all weather or operational conditions. ⸻ 16. Third-Party Service Providers Hotels, airlines, railways, restaurants, guides, transport operators, activity providers and other suppliers are independent third parties. Motherland India Holidays Pvt. Ltd. will exercise reasonable care in selecting and coordinating suppliers but does not own or control all third-party services. Supplier-specific terms may apply in addition to these Terms & Conditions. Where a third-party supplier is responsible for a service, any complaint relating specifically to that service may also be subject to the supplier’s own terms and applicable law. ⸻ 17. Itinerary Changes Travel itineraries may occasionally require modification due to: * Weather; * Natural events; * Traffic; * Road conditions; * Government restrictions; * Security conditions; * Local events; * Supplier operational changes; * Flight or railway schedule changes; * Hotel availability; * Force majeure; or * Other circumstances beyond our reasonable control. We will make reasonable efforts to provide a suitable alternative where possible. No itinerary should be treated as absolutely guaranteed until the relevant services are confirmed. ⸻ 18. Force Majeure Motherland India Holidays Pvt. Ltd. shall not be liable for failure, delay or alteration of services caused by circumstances beyond its reasonable control, including but not limited to: * Natural disasters; * Floods; * Earthquakes; * Severe weather; * Epidemics or pandemics; * War or threat of war; * Terrorism or security incidents; * Civil unrest; * Strikes or industrial action; * Government restrictions; * Border closures; * Political disturbances; * Transportation disruptions; * Supplier failure; * Road closures; * Airport disruptions; or * Other events of force majeure. In such circumstances, refunds or compensation will depend upon the amounts recovered from the relevant suppliers and applicable law. ⸻ 19. Traveller Responsibilities Travellers agree to: 1. Provide accurate passenger information; 2. Provide correct passport and travel-document details; 3. Make payments within the agreed timelines; 4. Follow applicable laws and local regulations; 5. Respect local customs and cultural practices; 6. Follow reasonable instructions from guides, drivers, hotels and activity providers; 7. Take reasonable care of personal belongings; 8. Arrive on time for scheduled services; and 9. Avoid behaviour that may endanger themselves, other travellers, staff or suppliers. The company reserves the right to refuse or discontinue arrangements where a traveller’s behaviour creates a serious safety, legal or operational concern, subject to applicable law. ⸻ 20. Personal Belongings Travellers are responsible for their personal belongings, passports, money, valuables, electronic devices and luggage. The company will not be responsible for loss, theft or damage to personal belongings except to the extent liability cannot lawfully be excluded or is directly attributable to the company’s proven negligence. Travellers should use hotel safes or other appropriate security facilities where available. ⸻ 21. Complaints & Service Issues We encourage travellers to report any service issue as soon as reasonably possible while travelling so that we have an opportunity to investigate and, where possible, resolve the matter during the trip. Complaints relating to a hotel, transport service, activity or other supplier should preferably be reported immediately to the relevant supplier and to our representative. Failure to report an issue during the trip may limit the opportunity to rectify the matter. Nothing in these Terms & Conditions is intended to restrict any statutory consumer rights available under applicable law. ⸻ 22. Website Information We make reasonable efforts to keep the information on our website accurate and current. However, destination information, hotel facilities, prices, photographs, travel times, attraction opening hours and other information may change. Website photographs and descriptions may be illustrative and may not exactly represent the service provided at the time of travel. We reserve the right to correct typographical, pricing or factual errors. ⸻ 23. Website Content & Intellectual Property All website content, including text, photographs, graphics, logos, designs, trademarks, videos and other materials, is owned by or licensed to Motherland India Holidays Pvt. Ltd., unless otherwise stated. Such content may not be copied, reproduced, modified, distributed, republished or commercially exploited without prior written permission. Third-party trademarks and logos remain the property of their respective owners. ⸻ 24. Privacy & Personal Data We may collect and process personal information necessary to provide travel services, communicate with travellers, process bookings, issue tickets, make hotel reservations, arrange transportation, comply with legal requirements and provide customer support. Personal data will be handled in accordance with applicable Indian data-protection and privacy laws and our Privacy Policy. Where required, personal information may be shared with relevant travel suppliers, payment processors, government authorities or service providers for legitimate purposes connected with the requested travel services. Our Privacy Policy should be read together with these Terms & Conditions. ⸻ 25. Payment Security We take reasonable measures to protect information submitted through our website and payment channels. However, no online transmission or electronic storage system can be guaranteed to be completely secure. Customers should not share passwords, OTPs, card PINs or other confidential banking information with anyone claiming to represent Motherland India Holidays Pvt. Ltd. The company will never require a customer to disclose a card PIN or banking password for processing a legitimate booking. ⸻ 26. Limitation of Liability To the maximum extent permitted by applicable law, Motherland India Holidays Pvt. Ltd. shall not be liable for indirect, incidental, special or consequential losses arising from circumstances beyond the company’s reasonable control. Where a service is supplied by an independent third party, liability relating to that service may be governed by the applicable supplier’s terms and applicable law. Nothing in these Terms & Conditions shall exclude or limit any liability that cannot legally be excluded or limited under applicable law, including applicable statutory consumer rights. ⸻ 27. No Waiver of Statutory Rights Nothing contained in these Terms & Conditions is intended to remove, restrict or waive any right or remedy that a customer is entitled to under applicable mandatory law. Governing Law These Terms & Conditions shall be governed by the laws of India.
